On December 2, 1892, Jay Gould died at his residence on Fifth Avenue. On instructions he had left, his personal correspondence and private business memoranda were destroyed at his death. The years for which those records would have most directly illuminated his role at the Texas and Pacific Railway Company the years from his entry through the bond syndicate in the fall of 1879 to his death in December 1892 are the years the destruction reached. Five Gould biographers across eighty-eight years have written from what survived. This book renders what the destruction did not reach. The Texas county courthouses where the deeds were filed. The Pennsylvania state archive at Harrisburg, where the construction company’s amended charter sits on the registry. The Annual Reports of the railway, filed under oath with the Texas Railroad Commission. The federal court reports of the litigation that ran across the railway’s lines. The contemporaneous press of the four East Texas counties along the main line. What it shows is that the corporation that built the Texas and Pacific Railway in 1872 and 1873 — the California and Texas Railway Construction Company, Pennsylvania Entity Number 53037 sits on the Pennsylvania corporate registry as of 2026, one hundred and fifty-four years after its charter was filed, with status Active. None of the three modern Gould biographers (Klein, Renehan, Steinmetz) addresses the 1902 Pennsylvania quo warranto ruling that placed the company’s thirty-year corporate history on the public record. The legend rests on the record that survived. The corrective rests on the record he could not reach. Read more
